SUMMARY OF YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:

DO NOTHING

If you do nothing, you will still receive any monetary award available to you under the Settlement, but you will not release any claims you may have under the Fair Labor Standards Act (“FLSA”).

In consideration for the monetary award you will receive, you will release any claims under the North Carolina Wage and Hour Act (“NCWHA”).

In order to receive a settlement payment, you must fully complete the I.R.S. Form W-9, provided along with this Notice, and return them to the Settlement Administrator by January 18, 2021. The I.R.S. Form W-9 can also be found here.

EXCLUDE YOURSELF FROM THE SETTLEMENT

If you do not wish to participate in the Settlement, you may exclude yourself by following the instructions in Section 10.B below. If you request exclusion, do not return the I.R.S. Form W-9.

Only those individuals who exclude themselves will retain any right they may have to pursue their own lawsuit or claims under the NCWHA in the future. Individuals who request exclusion will not release any NCWHA claims as part of this Settlement, but also will not receive any monetary award as part of the Settlement.

OBJECT

If you were employed by PCG as a manufacturing and/or assembly line employee or similar position, at any time between January 31, 2016, and November 6, 2020, and were not compensated at the appropriate one and one-half (1.5) times your regular hourly rate for all hours worked, including, but not limited to, hours in excess of forty (40) per week; did not opt out of this action; or never received notice of the lawsuit and do not exclude yourself by following the instructions in Section 10.B below, you can write the Court about why you object to the Settlement.
